PHMSA announced that the agency and its modal partners will temporarily exercise enforcement discretion for any offeror or carrier currently shipping packages marked, labeled, or transported in accordance with the internationally adopted 2023-2024 Edition of the ICAO Technical Instructions or the Amendment 41-22 of the IMDG Code until otherwise stated. Additionally, the agency will not take enforcement action against those transporting polymerizing substances in accordance with the Hazardous Materials Regulations that are in effect on December 31, 2022.
The enforcement discretion will remain in effect while the agency is considering adopting updated editions of the ICAO Technical Instructions and IMDG Code into the Hazardous Materials Regulations.
