The Occupational Safety and Health Administration has proposed more than $3.5 million in penalties against three employers following a sulfuric acid spill and subsequent cleanup response at the BWC Terminals facility in Channelview, Texas.
According to OSHA, fresh and spent sulfuric acid were mixed despite safety warnings, causing a tank overpressure that ruptured a supply line. Approximately one million gallons of sulfuric acid were released, and multiple employees were injured.
OSHA’s inspections covered the terminal operator, the environmental cleanup contractor, and a subcontractor supplying cleanup labor. The alleged violations included deficiencies involving hazardous-materials training, respirator fit testing and respiratory protection, worker safety programs, emergency-response planning, and protection from chemical burns.
The largest proposed penalty—more than $3 million—was issued to the subcontractor that OSHA says sent workers into the cleanup operation without adequate training, respirator fit testing, or other required safeguards.
