June 4, 2020: Petition for Waiver of Compliance

Canadian Pacific has petition FRA for a waiver of compliance from 49 CFR 241.7(c), Fringe border dispatching. This would permit Canadian dispatching from CP’s Operations Center located in Calgary, Alberta, Canada (CP Calgary OC) for the recently acquired Central Maine and Quebec Railway (CMQR) track segments on the Newport Subdivision within the U.S. There are three seperate locations where the Newport Subdivision crosses the U.S./Canada border. This relief would apply to two of those track segments.
Canadian Pacific insists all trains that are operated in the U.S. will be under the control of a single crew and the dispatching will be provided by bilingual train dispatchers. This will allow the train crews to communicate with the dispatchers in their primary language. CP also states that the dispatching will be transferred to a U.S. carrier where the interchange takes place.
Interested parties may submit comments on the petition until July 20, 2020. All comments must include the docket number.
