Union Pacific Railroad submitted a petition to FRA seeking a waiver of compliance from 49 CFR 229.21, Daily inspections. Union Pacific would like to forgo the daily inspections on Distributed Power (DPU) locomotives that are enroute. The inspections would still be performed prior to the locomotive departing from its originating terminal and prior to its next usage after arriving at its destination. However, DPU locomotives typically arrive at their destinaDistion within 48-72 hours but can take as long as 96 hours.
Union Pacific feels that performing daily inspections on DPU locomotives poses an unnecessary safety risk for the both public and the crew members as the inspections generally take place along the main line and in close proximity to live tracks. The inspections can also lead to train delays and blocked crossings.
Interested parties may submit comments until May 28, 2019.
