November 5, 2018: Petition for Waiver of Compliance

BNSF submitted a petition for waiver of compliance from certain aspects of the recordkeeping regulations. Specifically,  49 CFR 225.25(h) which states, in part, ‘‘Except as provided in paragraph (h)(15) of this section, a listing of all injuries and occupational illnesses reported to FRA as having occurred at an establishment shall be posted in a conspicuous location at that establishment, within 30 days after the expiration of the month during which the injuries and illnesses occurred, if the establishment has been in continuous operation for a minimum of 90 calendar days.’’
According to the petition, BNSF has created an electronic version of the monthly listing of all employee injuries, occupational illnesses, or fatalities. The electronic version will be available to employees via computer terminals in company facilities or on personal devices and would replace the paper posting of the monthly report.
Interested parties may submit comments on the petition until December 20, 2018.
