CSX Transportation Inc. has petitioned the Federal Railroad Administration for a waiver of compliance from 49 CFR 234.247, Purpose of inspections and tests; removal from service of relay or device failing to meet test requirements.
CSX plans to move around 400 rail cars and rail-bound equipment currently being stored at its Illinois Subdivision, which has been discontinued from service pursuant to the Surface Transportation Board’s issuance of two Discontinuance of Service Exemptions on December 10, 2015 and January 9, 2017.
CSX is seeking permission to skip the required inspections and tests prior to moving the currently stored cars and equipment. According to CSX, the cars and equipment would be moved during daylight hours, over non-functioning highway-rail crossings, and would not exceed 10 mph. In addition, CSX has stated they would position an employee at each grade crossing to warn approaching highway traffic and will work with local authorities to ensure they have permission to close the roadway at the impacted crossings.
Interested parties may submit comments on the petition until October 19, 2018.
