BNSF Railway has submitted a petition to FRA requesting a waiver of compliance that would permit employees who are certified under 49 CFR part 240 or 242 to exceed the required 1,095 days between audiometric testing if they meet the hearing acuity timelines laid out in the regulations.
BNSF would like to extend the audiometric testing to 1,460 days in an effort to reduce confusion caused by multiple hearing test requirements under parts 240 and 242 of the regulations.
Interested parties may submit comments on this petition until September 26, 2018.
